Acceptance of Terms
By creating a YouNegotiate creditor account or using the platform, you agree to these Platform Terms & Conditions (“Terms”). If you do not agree, you may not use the platform. These Terms form a legally binding agreement between you (“Creditor”, “Member”, or “You”) and H2H Technologies, the owner and operator of YouNegotiate® (“YouNegotiate”, “we”, “our”, or “us”).
About the YouNegotiate Platform
YouNegotiate® is a digital billing, communication, and self-service platform that enables creditors and consumers to manage account communications, payment options, disputes, and settlement workflows through a secure online environment. YouNegotiate® is a facilitation and technology platform only and does not operate as a debt collection agency, law firm, credit repair organization, or payment processor. All payments are processed through third-party processors and deposited directly into the creditor’s designated merchant account.
The tools and features available to creditor members are described in the YouNegotiate® Services Overview (“Exhibit A”), which may be updated periodically.
Communications Content
By creating, accessing, or using a YouNegotiate® ecoPortal™, ecoAddress™, or any related services, you consent to receive electronic communications from YouNegotiate®, H2H Technologies LLC, Debt Free Americans, participating creditors, and authorized service providers as necessary to provide the services offered through the platform.
Electronic communications may include account verification messages, account notifications, document delivery alerts, account updates, security notifications, authentication requests, reminders, and other service-related communications.
SMS Text Message Communications
When you provide a mobile telephone number and consent to receive text messages, you authorize YouNegotiate® to send SMS text messages related to your account and use of the platform.
Message frequency may vary based on account activity and communication preferences. Message and data rates may apply according to your mobile carrier plan.
Consent to receive SMS messages is not required to purchase any products or services.
You may opt out of SMS communications at any time by replying STOP to any text message, updating your Communication Profile, or contacting customer support.
Email Communications
When you provide an email address and consent to receive electronic communications, you authorize YouNegotiate® to send emails related to your account and use of the platform.
You may manage your email communication preferences through your Communication Profile or by using the unsubscribe options provided in applicable email communications.
Communication Profile Preferences
Consumers and creditors may manage their communication preferences through their Communication Profile within the platform. Communication preferences may include the selection of email, SMS text messaging, or other available communication methods.
By selecting and enabling a communication method within your Communication Profile, you consent to receive communications through that selected method in accordance with these Terms.
Record of Consent
You acknowledge and agree that YouNegotiate® may maintain records of your consent, communication preferences, authentication events, opt-in actions, opt-out requests, and related activity for compliance, security, operational, and legal purposes.
Service-Related Communications
Certain communications are necessary for security, authentication, account administration, regulatory compliance, and operation of the platform. You acknowledge that opting out of certain communications may limit functionality or access to portions of the platform that require authentication, security verification, or account notifications.
Membership Plans and Fees
Membership plans are based on the number of accounts hosted on the platform. Fees may be billed monthly or annually and are non-refundable except as required by law. Fees cover hosting, compliance tooling, secure communications, and platform access. H2H Technologies reserves the right to suspend or terminate accounts for non-payment, misuse, or policy violations.
Data Ownership and License
You retain ownership of all data you upload. By uploading data, you grant H2H Technologies a limited, non-exclusive, royalty-free license to host, process, transmit, and store such data solely to operate the platform and provide services. H2H Technologies is not responsible for inaccurate, incomplete, or unlawful data provided by creditors.
Compliance Responsibilities
H2H Technologies provides tools designed to support compliance with applicable consumer communication and financial regulations. However, creditors remain solely responsible for compliance with all applicable federal, state, and local laws related to their accounts, communications, and payment activities.
Account Access and Suspension
Creditor accounts may include a limited number of authorized users as defined by the selected membership plan. H2H Technologies may suspend, restrict, or terminate access if misuse, non-payment, or security risks are identified.
Communications and ecoLetters
All communications initiated through the platform must be prepaid unless otherwise agreed in writing. H2H Technologies maintains communication audit logs for compliance and operational purposes. Consumer access may be limited or deactivated based on account status or expiration.
Use of Contact Information
YouNegotiate® and Debt Free Americans use mobile phone numbers and email addresses solely for account-related communications, authentication services, security notifications, document delivery alerts, account updates, and platform reminders.
We do not sell, rent, or share your mobile phone number or email address with third parties for their marketing purposes.
Your contact information will never be used to send marketing, promotional, or advertising messages.
All use of personal information remains subject to our Privacy Policy.
Intellectual Property
All platform technology, trademarks, service marks, logos, and proprietary systems are owned by H2H Technologies or its licensors. Authorized members may display approved YouNegotiate® branding solely to identify platform participation and may not imply ownership, endorsement, or partnership beyond authorized use.
Confidentiality
Each party agrees to protect the confidentiality of non-public business, technical, and consumer information obtained through the platform and to use such information solely for permitted purposes.
Termination
Membership may be canceled at any time in accordance with platform procedures. H2H Technologies may immediately suspend or terminate access for non-payment, misuse, or legal violations. Certain data may be retained for audit, legal, and compliance purposes.
Limitation of Liability and Indemnification
To the maximum extent permitted by law, H2H Technologies is not liable for indirect, incidental, consequential, or special damages. You agree to indemnify and hold harmless H2H Technologies from claims arising out of misuse of the platform, inaccurate data, or legal non-compliance.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively through binding arbitration in Nevada. Class or representative actions are not permitted.
Updates to Terms
H2H Technologies may update these Terms periodically. Notice will be provided via email or in-platform notification. Continued use of the platform after notice constitutes acceptance.
