Purpose and Scope
This Regulatory Compliance page describes the regulatory frameworks, industry standards, and compliance principles applicable to the YouNegotiate platform. H2H Technologies operates YouNegotiate as a financial communication and self-service technology platform and is not a debt collection agency, payment processor, or legal advisor.
Platform Role and Responsibility
YouNegotiate provides secure tools that facilitate communications, disclosures, payments, and negotiations between creditors and consumers. Each creditor or member remains solely responsible for ensuring compliance with all applicable laws governing their accounts, communications, and financial activities.
Fair Debt Collection Practices Act (FDCPA)
The FDCPA regulates how third-party debt collectors communicate with consumers. YouNegotiate provides compliance-supporting tools such as audit logs, written communication delivery, and consumer self-service features. Use of the platform does not transfer FDCPA compliance responsibility from creditors or their authorized agents.
Consumer Financial Protection Bureau (CFPB) Oversight
The CFPB enforces federal consumer financial laws and oversees fair, transparent consumer treatment. YouNegotiate supports CFPB-aligned best practices by enabling clear disclosures, documented communications, and consumer access to account information.
Telephone Consumer Protection Act (TCPA) and CAN-SPAM
TCPA governs telephone calls and SMS messaging, requiring appropriate consent and opt-out mechanisms. CAN-SPAM establishes requirements for commercial email communications. YouNegotiate provides opt-out mechanisms, consent tracking, and communication logs; however, creditors are responsible for ensuring proper consent.
Payment Card Industry Data Security Standard (PCI DSS)
YouNegotiate does not store or process full payment card data. All card transactions are processed through PCI DSS–compliant third-party payment processors. The platform uses tokenization and secure transmission methods to reduce payment data exposure.
Gramm-Leach-Bliley Act (GLBA) Safeguards
GLBA requires financial institutions to protect consumer financial information. YouNegotiate implements administrative, technical, and physical safeguards designed to protect nonpublic personal information processed within the platform.
Data Privacy and State Laws
YouNegotiate supports compliance with applicable U.S. state privacy laws, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). Users may exercise applicable privacy rights as described in the Privacy Policy.
Healthcare and Medical Billing (When Applicable)
For accounts involving medical billing, YouNegotiate supports secure communications and data handling practices aligned with HIPAA principles. YouNegotiate does not act as a healthcare provider or insurer.
Audit, Monitoring, and Recordkeeping
The platform maintains audit logs, access records, and communication histories to support compliance reviews, dispute resolution, and regulatory inquiries.
Third-Party Service Providers
YouNegotiate relies on vetted third-party vendors for hosting, payment processing, messaging, and analytics. These providers are selected based on security, compliance posture, and contractual obligations.
Regulatory Changes
Financial and privacy regulations evolve over time. YouNegotiate may update platform features and policies to reflect regulatory changes. Continued use of the platform constitutes acceptance of updated compliance practices.
